This Privacy Policy is incorporated by reference into MianU Wines, LLC Terms of Use Agreement (the "Terms").

The term "MianU", "we," and "us" includes MianU Wines, LLC and our affiliates and subsidiaries.

This Privacy Policy explains how we may collect, use, and/or disclose personal data that we obtain through the website located at mianuwines.com (the "Site"), through email newsletter sign-ups, and through our integrations with third-party service providers including Google Analytics, Mailchimp, AccessiBe, Squarespace, and advertising or social media platforms such as Meta (Facebook/Instagram), Twitter, TikTok, YouTube, and Google Ads (collectively, the "Services").

2. Who We Are

MianU is responsible for the processing of your personal data and acts as the data controller for such processing. 3. Types of Data We Collect

When you use the Services, we collect and use certain personal data about you. We collect personal data about you from a variety of sources, including from you directly (e.g., when you place an order through the Site or contact us by email), automatically when you use the Services (e.g., data collected via cookies and similar tracking technologies as described below), and from other sources, including commercially available sources, such as public databases (where permitted by law). Note that we may be required by law or to enter into a contract with you to collect certain personal data about you. Failure to provide this information may prevent or delay the fulfillment of these obligations.

Personal data we collect directly from you

• If you place an order with us, we collect your name, e-mail, and billing and shipment addresses.

• If you make payments through the Services, you may need to provide personal data such as your credit card number. For purchases made through the Site, you may be required to provide certain personal data to our third-party payment processor in order to complete your purchase.

• To enhance and personalize your shopping experience, we collect personal data about your orders and the use of our Services (e.g., the purchases you make, search terms you enter, links you click, how you interact with the Services, etc.).

Personal data we automatically collect when you use the Services

4. How We Use Data

a.     Uses of Personal Data

We collect, use, retain, disclose, and otherwise process personal data for the following purposes:

To provide, administer, and maintain the Services. We use personal data to provide the Services to you, including, among other things, to provide the content and features of the Site, to process and fulfill orders you submit, and to provide customer support.

Customizing your experience. When you use the Services, we may use your personal data to improve your experience of the Services, such as by providing interactive or personalized elements within the Service and providing you with content based on your interests.

To improve the Services. We use personal data to improve the Services, including to analyze performance of the Services, troubleshoot the Services, and develop new features and new offerings in connection with the Services.

Exercising our rights. We may use personal data to exercise our legal rights where necessary, for example, to detect, prevent, and respond to claims of fraud, intellectual property infringement claims, or violations of law or our terms of use, or to protect our rights, privacy, safety, or property, or that of our affiliates and subsidiaries, you, or other third parties.

Complying with our obligations. We may process personal data to comply with legal obligations and legal process.

In the event of a business transfer. We may process or disclose personal data in the event of a business transfer, as described below in the How We Share Data section.

De-Identified Information and Aggregate Data. We may de-identify and/or aggregate personal data so that it cannot be linked to you or any other individual. Deidentified data and aggregated data is not considered “personal data” and may be subsequently used for any purpose. We will maintain and use this data only in deidentified form and will not attempt to re-identify the data.

b.     Legal basis for processing your data

Where required under local law, we rely on the following legal bases when processing your personal data:

1. Performance of the contract we have with you (for example, when you place an order, we need certain personal data in order to process and deliver your order).

 2. Compliance with legal obligations to which we are subject (such as when we are obliged to comply with lawful requests from competent authorities such as law enforcement).

3. To serve our legitimate interests (such as tailoring your experience with our Services, carrying out online advertising, and for fraud detection). When we use personal data to meet our legitimate interests, we take steps to ensure that your rights to your personal data are not infringed. You can contact us using the details set out in the How to Contact Us section below for more information about the steps we take to ensure these rights are not infringed. You also have the right to object to such processing as described in the Privacy Rights section above.

To the extent that a legal basis described above would not apply to processing of your personal data by us, we will seek your consent for such specific purpose in accordance with applicable law (such as sending direct marketing messages by electronic means, like email, without an exception from the requirement to obtain consent).

5. How We Share Data

We may disclose personal data under the following circumstances:

Vendors and Service Providers. We may disclose personal data to vendors and service providers retained in connection with the provision of the Services. For example, we may use a payment processing company to receive and process your credit card transactions for us. This may also include, among others, IT, delivery, and marketing service providers. These service providers process personal data on behalf of MianU and are subject to appropriate contractual obligations relating to data protection and security controls.

Displaying to Other Users. The content you post to the Site may be displayed on the Site. Other users of the Site may be able to see some information about you, such as your name if you submit a review. We are not responsible for the privacy practices of the other users who will view and use the posted information.

Marketing. We may disclose personal data collected by the Services for marketing purposes, such as to facilitate transmission of information that may be useful, relevant, valuable, or otherwise of interest to you. For example, we may disclose personal data to third parties that provide certain marketing services to us, including with third-party advertisers, in order to suggest relevant products and offers for you, or to perform certain modeling services. Additionally, we may share personal data with our business partners, affiliates, any other third party, or third-party marketing partners for their own marketing purposes. For example, we may share personal data with certain partners in order to print shipping addresses onto items purchased using the Services, and for segmentation of email addresses to provide you with more relevant email content.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information, including personal data, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect yours, ours or others' rights, property, or safety.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be disclosed, sold or transferred as part of such a transaction as permitted by law and/or contract.

6. Data of Minors

We do not knowingly collect, maintain, or use personal data from individuals who are under 21 years of age, and no part of the Services is directed to children.  If you learn that your child has provided us with personal data without your consent, you may alert us at hello@mianuwines.com.

7. International Transfers of Data

Your personal data may be transferred to, stored, and processed in a country (such as the United States) that does not provide the same level of privacy protections as the laws of your home country. We have put in place appropriate safeguards (such as contractual commitments) in accordance with applicable legal requirements to provide adequate protection for your personal data. 8. Your Privacy Rights and Choices

Residents of the European Union, the United Kingdom, certain US states, and certain other jurisdictions may have some or all of the following rights:

• Right to Know and Access: the right to request information about the personal data that we collect, use, and disclose, including the right to access the specific pieces of personal data we have collected about you and information about the third parties to which we have disclosed personal data.

• Right to Correct: the right to request that we correct inaccurate personal data.

• Right to Delete: the right to request that we delete personal data that we collected from you, subject to certain exceptions.

Exercising Your Rights

You may submit requests to know, access, correct, delete, restrict, object, or data portability by contacting us at the information provided in the How to Contact Us section or at hello@mianuwimes.com. We may require additional information from you so that we can verify your request.

You or your authorized agent may opt out of “sales”, “sharing”, and “targeted advertising” by clicking here and following the instructions.  Where applicable under local law, we also honor requests to opt out submitted via privacy preference signals, such as the Global Privacy Control (GPC). Where applicable under local law, we will honor a request from an authorized agent provided that for requests other than opt-outs, (i) you provide written authorization to the agent to act on your behalf and we can verify your identity, and (ii) the agent submits proof of authorization.

We implement technical and organizational measures designed to ensure a level of security appropriate to the risk of the personal data we process. These measures are aimed at ensuring the ongoing integrity and confidentiality of personal data.

MianU cannot guarantee the content or privacy practices of any such third-party websites and does not accept responsibility for such websites. We will retain your information for the duration of our relationship with you. Once our relationship with you has come to an end, we will retain your personal data for a period of time that takes into account the following:

• The purpose(s) and use of your information both now and in the future (such as whether it is necessary to continue to store that information in order to continue to perform our obligations under an agreement with you or to contact you in the future).

• Whether we have a legal obligation to continue to process your information (such as any record-keeping obligations imposed by relevant law or regulations).

• Relevant agreed industry practices on how long information should be retained.
